Planfit is a service that provides workout content to members on mobile. In these Terms of Use, "Company" means "Planfit Inc." that provides “Planfit Services”.
IMPORTANT NOTICE FOR U.S. MEMBERS — PLEASE READ CAREFULLY: These Terms contain provisions that govern how disputes between you and Planfit are resolved, including an agreement to resolve disputes through binding individual arbitration and a waiver of your right to participate in a class action or jury trial. Please review the Dispute Resolution section carefully. Unless you opt out of arbitration within 30 days of first accepting these Terms, you will be bound to resolve disputes through binding arbitration on an individual basis.
These Terms of Use ("Terms") govern your individual access to or use of applications, websites, content, products, and services made available by Planfit (the "Services"). Please read these Terms carefully before accessing or using the Services. In these Terms, "including" and "include" mean "including, but not limited to."
Your access to and use of the Services is deemed to constitute your agreement to these Terms. If you do not agree to these Terms, you may not access or use the Services. These Terms expressly supersede any prior agreements or arrangements with you. Planfit may immediately terminate these Terms or any Services with respect to you, or generally cease offering or deny access to all or any portion of the Services, at any time and for any reason.
Planfit may amend the Terms relating to the Services from time to time and will notify you of any changes at least 7 days prior to their effective date. For amendments that adversely affect you, Planfit will provide notice at least 30 days in advance. Your continued access to and use of the Services after such notice is deemed to constitute your agreement to the amended Terms.
(1) "Company" means the entity (Planfit Inc.) that provides the Services.
(2) "Services" means all services and features provided by the Company.
(3) "Member" means a person who registers for membership and uses the Services.
Members of Planfit must use the Services and all content provided through the Services solely for personal, non-commercial purposes.
Planfit provides the following Services:
(1) Exercise routine recommendation
(2) Trainer chat and management
(3) Community
(4) Other services determined by the Company
The Services, including routine content, are updated regularly. In addition, Planfit may continuously test and modify various aspects of the Services, such as the user interface, Planfit content, and its availability, as needed for operational or technical reasons.
Members agree to use Planfit Services (including all features within the Services) in compliance with all applicable laws, rules, regulations, and other restrictions related to the use of Planfit's services and content. Members agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, solicit sales of, or use (except as expressly permitted in these Terms) any content and information contained in or acquired through the Planfit Service. In addition, Members shall not bypass, delete, modify, invalidate, weaken, or damage the content protection functions within the Planfit Service; access the Planfit Service using robots, spiders, scrapers, or other automated means; modify, analyze, or disassemble (including by way of reverse engineering) any software or other product or process accessible through the Planfit Service; insert any code or product, or otherwise manipulate the content of the Planfit Service in any manner; or use data mining, data collection, or data extraction methods. Furthermore, Members shall not upload, post, transmit by email, or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of computer software, hardware, or communications equipment associated with the Planfit Service, including software viruses, other computer code, files, or programs. If a Member violates these Terms or engages in illegal or fraudulent use of the Services, Planfit may terminate or restrict the Member's use of the Services.
The Services may be temporarily suspended for regular or temporary inspections to maintain or repair equipment, or for other significant reasons.
Planfit may modify all or part of the Services according to operational or technical needs where there is a reasonable cause. In addition, the Company may modify, suspend, or discontinue all or part of the Services provided free of charge in accordance with the Company's policies and operational needs, and no separate compensation will be provided unless specifically provided otherwise under applicable law.
